These terms govern your use of Marvin XR, a hosted service that creates 3D models from product images and publishes augmented reality (AR) pages for them. They apply whether you use Marvin XR through the dashboard at admin.marvinxr.com, through our Shopify app, through our WooCommerce plugin, or through our API.
Marvin XR is operated by Marvin XR. You can reach us at support@marvinxr.com.
1. The service
Marvin XR generates a 3D model from images you supply, hosts a viewer page for that model, and provides tools to embed a link to it in your online store. Generation runs on our servers and on third-party model-generation infrastructure we contract with. We do not promise that a generated model will be suitable for any particular purpose; results depend on the image you supply.
2. Your account
You need an account to use Marvin XR. You are responsible for what happens under it, including anything done by stores you connect to it. Keep your credentials and any connection tokens confidential. Tell us promptly if you believe an account or a connected store has been compromised.
You may connect more than one store to one account. Usage allowances are counted against the account, not against each store.
3. Plans, credits and payment
Marvin XR offers a free allowance and paid plans. Current plans and prices are shown at marvinxr.com/pricing, and where you subscribe through a marketplace such as the Shopify App Store, that marketplace’s own billing terms also apply.
Each 3D model generation consumes part of your allowance. A generation that fails does not consume it. Unless stated otherwise on the pricing page, paid plans renew automatically for successive periods until cancelled, fees are payable in advance, and fees already paid are not refundable except where required by law.
Plans described as offering unlimited generation are subject to a fair-use ceiling, published on the pricing page. Reaching it pauses further generation rather than creating an additional charge, and we will contact you before it affects normal use.
We may change prices. If a change affects a plan you are on, we will tell you at least 30 days beforehand, and you may cancel before it takes effect.
4. Your content
You keep ownership of the images you upload and of the 3D models generated from them. You grant us the licence we need to run the service: to store, process, transmit and display that content for the purpose of generating models, hosting viewer pages you publish, and supporting your account. That licence ends when the content is deleted, except for backups kept for a limited period.
You are responsible for having the rights to the images you upload. Do not upload content you are not entitled to use.
AR pages you publish are public by design: anyone with the address can view them. Do not publish anything through Marvin XR that you would not put on your own website.
5. Acceptable use
Do not use Marvin XR to break the law, to infringe someone else’s rights, or to generate models of content that is unlawful, or that depicts identifiable people without their consent. Do not attempt to disrupt the service, work around usage allowances, resell access without a written agreement with us, or use automated means to create accounts or consume the free allowance in bulk.
We may suspend an account that we reasonably believe is doing any of these, and will tell you why.
6. Third-party services and stores
Marvin XR connects to platforms such as Shopify and WooCommerce, and uses third-party infrastructure to generate models. Those are separate services with their own terms, and we are not responsible for them. Connecting a store authorises us to read the product data needed to do what you ask, and nothing more.
7. Availability
We work to keep Marvin XR available and will give notice of planned maintenance where we reasonably can, but we do not guarantee uninterrupted or error-free service. Published AR pages, generation, and the dashboard may be unavailable from time to time.
8. Data protection
How we handle personal data is described in our Privacy Policy, which forms part of these terms. Where you use Marvin XR’s lead-capture feature, you are the controller of the details collected and we process them on your behalf.
9. Ending the agreement
You may stop using Marvin XR at any time, disconnect a store from its settings screen, and cancel a paid plan as described on the pricing page. We may end or suspend your access if you materially breach these terms, or if we stop offering the service, in which case we will give reasonable notice.
When an account closes, published AR pages stop being served and your content is deleted after a short retention period. Export anything you want to keep before closing an account.
10. Liability
Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud. Subject to that, Marvin XR is provided as-is; we exclude implied warranties to the extent the law allows; we are not liable for lost profits, lost revenue, lost data or indirect or consequential loss; and our total liability in any twelve-month period is limited to the amount you paid us for the service in that period.
11. Changes to these terms
We may update these terms. If a change materially affects your rights we will give at least 30 days’ notice by email or in the dashboard. Continuing to use Marvin XR after a change takes effect means you accept it.
12. Governing law
These terms are governed by Danish law, and the courts of Denmark have exclusive jurisdiction, except that we may bring proceedings to protect our intellectual property in any competent court. If you are a consumer, this does not remove protections you have under the mandatory law of the country you live in.
13. General
If any part of these terms is found unenforceable, the rest continues to apply. Our not enforcing a term is not a waiver of it. You may not transfer your rights under these terms without our consent; we may transfer ours as part of a reorganisation or sale of the business.
